The Opportunity
We are seeking an Associate General Counsel. Root is looking to grow our legal team! We are looking for someone who brings expert legal analysis, oversight, and litigation experience, to a national inventory of pre-litigation claims and active lawsuits brought against the company involving claims handling, policy provisions and exclusions, class actions, point of sale issues, telematics, and other exposures identified as extra-contractual. This requires identifying, retaining, managing, monitoring, auditing, and collaboration with outside defense counsel in defense of the company, and also working closely with legal department and compliance colleagues. Additionally, provides ongoing good-faith claim handling and product recommendations upon request in order to reduce overall risk.

Salary Range: $135,000 to $180,000
How you will make an impact:
- Assesses, reports, and recommends pre-litigation and litigation courses of action deeply couched in strategy and risk analysis that minimize risk to Root and its insureds;
- Reviews, evaluates, investigates, and makes recommendations on behalf of the company relative to claims and lawsuits presenting identified extra-contractual exposures;
- Manages national inventory of extra-contractual matters, including class actions, together with legal department colleagues to achieve appropriate outcomes;
- Regularly researches state law trends in both statutes and case law regarding insurer duties and obligations, as well as trends involving litigated extra-contractual matters;
- Manages internal litigation holds, assists with reinsurer reporting, discovery productions, deposition attendance, as well as trials, mediations, and other proceedings as appropriate;
- Responsible for the identification, due diligence review, retention, fee negotiation, monitoring, auditing, and dismissal, of extra-contractual panel counsel, with an emphasis on timely reporting, evaluation, and fair billing without compromising attorney independence;
- Reviews and provides guidance as requested on written claims materials and programs with an eye towards enhancing good-faith claims handling strategies and extra-contractual exposure mitigation
- Produces decision-oriented written work product to educate and assist corporate decision-makers.
What you will need to succeed
- J.D. from an ABA-accredited law school
- Excellent academic credentials (top 10% preferred)
- Law review and judicial clerkship
- 5+ years as an attorney working in a mid- to large-sized law firm defending first- and third-party claims on behalf of insurers and insureds
- 5+ years of direct experience litigating extra-contractual claims brought against insurers by insureds or assignees
- Extensive knowledge and familiarity with property and casualty principles and
- Working knowledge of financial and reinsurance agreements preferred.
